& POLICIES OF
CANTON VILLAGE
CONDOMINIUM ASSOCIATION
Introduction
Earlier Rules Replaced:
These rules replace any rules or regulations previously adopted by the
association, whether or not they were recorded on the land records of the town
or towns in which the condominium is located.
Persons Bound by the Rules:
All unit owners, tenants, holders of security interests, and occupants of
units, and their family members, guests, employees, contractors, and other
invitees shall comply with these rules.
Fines and Fees: Following notice and hearing, the Executive
Board may levy a fine of up to $25.00 per day plus costs for each individual
violation (unless otherwise stated) of the community documents and for each day
that the violation persists after the executive board votes to impose the
initial fee.
Section 1: Use of Units
1.1 Occupancy Restrictions.
Units are limited to resident use. No industry, business, trade or commercial
activities, other than home professional pursuits without public visits, shall
be conducted, maintained or permitted on any part of the condominium complex.
1.2 Lease/Rental of
Units. Upon renting/leasing a unit, the unit owner will supply the association,
via the management company, with the tenant's name, phone number, vehicle and
pet information. The unit owner will also supply the association, via the
management company, with a copy of the current lease. Failure to supply this
information to the association will result in a $100.00 fine to the unit owner. All documents will be submitted to the
management company within 30 days of tenant occupancy.
1.3 For
each unit that is not occupied by a unit owner, or that is also occupied by
persons who are not a unit owner:
a. If it is a non-owning spouse tenancy, notify
the management company.
b.
A description of the terms of the
agreement by which each occupant occupies the unit, including the type of
agreement (e.g. a lease), whether the arrangement is in writing, and the length
of the term. The lease must include proof that tenants were provided the
following:

2. Instructions on
location and use of water and electricity shut off
1.4 No unit owner or tenant may contract to have
work done at the expense of the Association.
Section 2: Trash & Recycling
2.1 All
trash must be disposed of by placing it in the dumpsters in the common elements
provided for such purpose. No trash may
be left next to or outside of the dumpsters or units.
2.2 Resident
household trash is the only permitted trash.
No building or remodeling waste is permitted. Landscape clippings must be bagged.
2.3 Trash
may not be stored in any way that permits the spread of fire, vermin, or
offensive odors, either indoors or outdoors.
2.4 Unit
owners and their tenants are required to adhere to current recycling guidelines
to properly dispose of these items. All cardboard must be flattened and placed
in proper recycling receptacles.
2.5 No
trash or other materials, including diapers, may be disposed of in toilets
which can cause blockages. Violation of this rule will cause all related
plumbing charges to be assessed against the unit.
2.6 Large
items that will not fit in the dumpster must be removed from the condominium complex
and disposed of at the expense of the unit owner. The minimum charge is $25.00
per item improperly disposed of at the association dumpsters.
2.7 No
cigarette butts or other litter may be discarded on porches or any ground in
the condominium complex.
2.8 Owners
may contact the management company for directions on having bulk waste removed
from the property.
Section 3: Use of Common Areas
3.1 Obstruction.
There shall be no obstruction of the common elements, including limited common
element open areas, nor shall anything be stored outside of the units other than
covered propane grills and patio furniture, nor shall any items be placed in
parking spaces other than vehicles without the prior written consent of the
association except as hereinafter expressly provided in these rules.
3.2 Outdoor
Structures and Outdoor Furniture. No structures or other objects or personal
property of any kind may be placed, kept, or stored in the limited common
elements or the common elements except as permitted under these rules.
3.3 Proper
Use. Common elements shall be used only for the purposes for which they were
designed. No person shall commit waste on the common elements or interfere with
their proper use by others, or commit any nuisances, vandalism, boisterous or
improper behavior on the common elements that interferes with, or limits the
enjoyment of the common elements.
3.4
There shall be no personal property,
with the exception of up to two (2) potted plants and up to one (1) front door
mat and one (1) seasonal decoration, kept on the front entrance stoop.
3.5 All gardens and flowerbeds created by
residents with prior approval from the association must be maintained on a
regular basis. If the association has
someone come in to weed and/or service such a planter bed, the unit owner will
be charged for the work.
Section 4: Additions and
Appurtenances to Buildings
4.1 No
alterations, additions or improvements may be made without prior consent of the
Board of Directors or such committee established by the board having
jurisdiction over such matters.
4.2 Painting
Exterior. Owners shall not paint, stain
or otherwise change the color of any exterior portion of any building without
the prior consent of the Board of Directors
4.3 Decks
shall be stained to match the approved color, which is on file with the
property manager.
4.4
All windows must have all mullions
intact. All window and door replacement plans must be submitted to the property
manager for Executive Board review.
4.5 Laundry.
No clothes, sheets, blankets, laundry or any other kind of articles, shall be
hung, displayed, exposed or placed on the outside walls, decks or doors of a
building, or on trees.
Section 5: Actions of Owners and Occupants
5.1 No
one shall make any noise, play any musical instrument, or operate any
electronic device or motor vehicle that is loud enough to disturb the occupants
of other units. If people of normal hearing can hear the sound from inside
other units with the doors and windows closed, it is too loud.
5.2 Annoyance
or Nuisance. No noxious, offensive, dangerous, or unsafe activity shall be
carried on in any unit or the common elements, nor shall anything be done
therein either intentionally or negligently, which may be or become an
annoyance or nuisance to the other unit owners or occupants.
5.3 Cleanliness:
Each unit owner shall keep his unit in a good state of preservation and
cleanliness.
5.4 Compliance
with Law. No immoral, improper, offensive or unlawful use may be made of the
condominium and unit owners shall comply with, and conform to, all applicable
laws and regulations of the United States and of the State of Connecticut, and
all ordinances, rules and regulations of the Town of Canton and shall save the
association and other unit owners harmless from all fines, penalties, costs and
prosecutions for the violation thereof or non-compliance therewith.
5.5
A minimum distance of 10’ from building
and privacy barriers must be observed when using propane grills. No other type
of grill or smoker is permitted.
Section 6: Signs, Flags and Displays
6.1 Displays
Outside of Units. Christmas or holiday decorations shall not be hung,
displayed, or exposed at, or on the outside of, windows without the prior
consent of the Board of Directors or such committee established by the board
having jurisdiction over such matter, if any. All holiday decorations must be
removed within 10 days after the holiday.
6.2 Signs
for Elections or Ballot Issues. Signs either for or against candidates for
public or association office or for or against public or association ballot
issues may be displayed provided:
a.
Signs must not exceed two feet by three
feet in size;
b.
Signs may only be located in the
windows of a unit, affixed to the interior;
c.
Signs must not contain comments on a
candidate's racial, religious, or ethnic background nor violate any local,
state, or federal hate laws;
d.
Signs may not be displayed earlier
than two weeks prior to the date of the election, referendum, or meeting at
which the candidates or ballot questions will be voted upon, nor may signs be
artificially lighted;
e. Signs must be
removed the day after the election, referendum, or meeting at which the votes
are taken; and
f. No more than two
(2) signs may be displayed by each unit.
Section 7: Insurance
7.1 Increase
in Rating. Nothing shall be done or kept which will increase the rate of
insurance on any of the buildings, or contents thereof, without the prior
written consent of the association. No unit owners shall permit anything to be
done or kept on the property which will result in the cancellation of insurance
coverage on any of the buildings, or contents thereof, or which would be in
violation of any law.
Section 8: Pets
8.1 No
animals, birds or reptiles of any kind shall be raised, bred or kept in the
condominium, except for no more than two (2) household pets. Household pets are defined as cats, dogs or
birds. Pets may not be kept, bred or
maintained for any commercial purposes. Any pet causing or creating a nuisance
or unreasonable disturbances or noise shall be permanently removed from the
property upon three (3) days written notice and hearing from the Board of
Directors.
8.2 Cats
shall be kept indoors, unless leashed and under control by a handler.
8.3
All dogs must be leashed and under
control of the handler when outside a unit.
Pets are prohibited from being tied to anything in the common or limited
common areas. All dog waste must be
removed by the owner immediately and placed in the rubbish dumpsters.
8.4 Dog
owners are liable for the actions of their dog and will be required to pay for
replacement of grass, bushes, or any other item damaged by their dog or injury
brought about by their dog.
8.5 All
dogs must be licensed by the Town Clerk and registered with the association.
Section 9: Motor Vehicles
9.1 Compliance
with Law. All persons will comply with Connecticut State Laws and Department of
Motor Vehicle regulations on the roads, drives and properties.
9.2 Registration.
All vehicles of owners and occupants regularly using the premises must be
registered with the manager.
9.3 No
unregistered or inoperable vehicles are allowed on association property for
more than one week without the prior written consent of the association.
9.4 Storage
of vehicles is prohibited. For the purposes of this document, storage is
defined as a period greater than 14 days.
9.5
Residents may park one car per licensed
driver in common parking areas.
9.6 No
vehicles making unreasonable noise are permitted on association property. The Town
of Canton vehicle noise ordinance shall control acceptable noise levels.
9.7 All
vehicles must be parked in a parking area. They may not be parked anywhere else
on the property.
9.8
None of the following are permitted in
common areas and/or limited common areas: unregistered or non-operable
vehicles, boats, campers, oversized commercial vehicles or vehicles with
excessive fluid leaks. No storage of vehicles in any common or limited common
area is allowed.
9.9 Vehicles
in violation of any of these rules may be towed at the owner’s expense. Association and management shall not be held
liable for damage during towing.
9.10 All Unit Owners must move their vehicles as soon as possible after a
storm to allow for final snow removal from the parking lot. Fines will be
assessed for failure to move:
1st offense:
parking tag
• 2nd offense: $25.00 fine
• 3rd
offense: towing at owner’s expense. Association and management shall not be
held liable for damage during towing.
9.11 Unit owners failing to move during plowing service must clear snow
from vehicle and clean parking area. Failure to clean area within 24 hours will
result in a $25.00 fine.
Section
10: Garage Units
10.1
A garage is to be used only for parking a
vehicle and storage use by the owner. A garage may be leased or sold only to a
resident of Canton Village Condominium Association. Garages must be owned by unit owners only.
10.2
No major appliance (refrigerator,
freezer, etc.) may be plugged into the garage electrical system, since the
electrical use in garages is a common expense of the Association.
10.3 No electrical cords may be run from a garage
to a unit or other area.
